These Terms & Conditions (the "Terms") govern your access to and use of the TG-EditThatPic website, application and related services (collectively, the "Service"), operated by Taksha Groups ("we", "us", "our"). By accessing or using the Service in any way, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Acceptance & Eligibility
By using the Service you represent and warrant that you are at least the age of majority in your jurisdiction (and in any case at least 18 years old), or that you are at least 13 and are using the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. You further represent that you are not barred from using the Service under any applicable law and that your use complies with all laws and regulations that apply to you.
2. The Service
TG-EditThatPic is a free, browser-based photo editor and virtual makeup studio. Image editing and makeup processing are performed locally on your device; your images are not, by design, uploaded to or stored on our servers. The Service is provided free of charge and is supported by advertising. We make no guarantee that the Service, or any feature, will be available, error-free, secure, compatible with your device, or fit for any purpose.
3. Licence to Use
Subject to your continuous compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Service for your own lawful, personal or internal use. We may suspend, restrict or terminate this licence at any time, for any reason or no reason, without notice and without liability to you.
4. Your Content & Responsibilities
You retain all rights to the images, files and other materials you open, create or edit using the Service ("Your Content"). You are solely and exclusively responsible for Your Content and for your use of the Service, and you represent and warrant that:
- you own or have all necessary rights, licences and consents to Your Content and to use it with the Service;
- Your Content and your use of it do not infringe or violate any intellectual property, privacy, publicity or other rights of any person, and do not breach any law; and
- you will not rely on the Service as the sole copy or repository of anything important to you.
Because processing happens on your device, we do not review, monitor, control or have access to Your Content, and we accept no responsibility or liability whatsoever for it.
5. Local Data & Backups
Projects you save are stored only in your own browser's local storage (e.g. IndexedDB) on the device you used. Such data may be deleted, corrupted or lost at any time, including by your browser, device, operating system, extensions, private-browsing mode, storage limits, software updates, or by clearing site data — none of which is within our control. You are solely responsible for maintaining your own backups. To the fullest extent permitted by law, we are not liable for any loss of, or inability to access, any data, images or projects.
6. Acceptable Use
You agree that you will not, and will not attempt to, do any of the following:
- use the Service for any unlawful, harmful, infringing, defamatory, obscene or fraudulent purpose, or to create, edit or distribute unlawful content (including non-consensual, sexually exploitative, or CSAM material), which is strictly prohibited;
- reverse engineer, decompile, scrape, overload, disrupt, probe, or attempt to gain unauthorised access to the Service or any system, account or data;
- circumvent, disable or interfere with security, advertising, or rate-limiting features;
- resell, redistribute, or commercially exploit the Service except as expressly permitted; or
- use the Service in any way that could harm us or any third party.
7. Intellectual Property
The Service, including its software, design, look and feel, text, graphics, logos, the "TG-EditThatPic" name and all related intellectual property, is owned by or licensed to Taksha Groups and is protected by law. Except for the limited licence in Section 3, no rights are granted to you. You may not use our names, trademarks or branding without our prior written permission.
8. Third Parties & Advertising
The Service is supported by advertising and may use third-party services and vendors (for example, Google AdSense and web fonts). Advertisements, links and any third-party content are provided by those third parties, not by us. We do not endorse, control, or assume any responsibility or liability for any third-party service, advertisement, content, product, website or conduct. Your dealings with any third party are solely between you and that third party. Your interaction with advertising and cookies is described in our Privacy Policy.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT ANY DATA, IMAGES OR RESULTS WILL BE ACCURATE, PRESERVED, OR MEET YOUR REQUIREMENTS. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED HEREIN.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case such warranties are limited to the minimum scope and duration permitted by law.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TAKSHA GROUPS, ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS (THE "RELEASED PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, IMAGES, FILES, PROJECTS, OR BUSINESS, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
WITHOUT LIMITING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY LAW, THE RELEASED PARTIES' TOTAL, AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (WHICH, FOR A FREE SERVICE, IS ZERO), OR (B) ONE HUNDRED INDIAN RUPEES (₹100).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (for example, liability for fraud, or for death or personal injury caused by negligence where such limitation is prohibited). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
11. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless the Released Parties from and against any and all claims, demands, actions, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or of any right of any third party.
12. Assumption of Risk
You acknowledge and agree that you use the Service voluntarily and at your sole risk, and that you assume full responsibility for any results obtained from your use of the Service and for any data or images you process, store or download.
13. Changes & Termination
We may modify, suspend, limit, or discontinue the Service or any part of it, and may update these Terms, at any time and for any reason, without notice and without any liability to you. We may update these Terms by posting the revised version with a new "Last updated" date; your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
14. Governing Law & Disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of India, without regard to conflict-of-laws principles, and you and we submit to the exclusive jurisdiction of the competent courts located in India. To the fullest extent permitted by law, any claim must be brought on an individual basis (not as a class or representative action) and within one (1) year after the claim arises, or it is permanently barred.
15. General
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them freely. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede all prior understandings. Headings are for convenience only.
